DMCA Policy
Peanut Butter Hot Chocolate ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond promptly to claims of copyright infringement committed using the Peanut Butter Hot Chocolate service or website if such claims are reported to our Designated Copyright Agent identified below.
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Peanut Butter Hot Chocolate website by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
Filing a DMCA Notice of Alleged Infringement
To file a DMCA notice of infringement, please provide our Designated Copyright Agent with the following information:
- Identify the copyrighted work that you claim has been infringed. This should include a description of the work, and where possible, a copy or the location (e.g., URL) of an authorized version of the work.
- Identify the material that you claim is infringing the copyrighted work, and its location on the Peanut Butter Hot Chocolate website. Please provide enough detail to allow us to find the material, such as specific URLs.

Upon receipt of a valid DMCA Notice, we will remove or disable access to the infringing material and take reasonable steps to notify the user who posted the material. We may also terminate repeat infringers.
DMCA Counter-Notification
If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information to our Designated Copyright Agent:
- Identify the material that has been removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or disabled.
- Provide your name, address, telephone number, and email address.
- Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Peanut Butter Hot Chocolate may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Provide your electronic or physical signature.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notification. If the original complainant does not file an action in court within 10-14 business days to restrain the user from engaging in infringing activity relating to the material on the Peanut Butter Hot Chocolate service, we may restore the removed material or cease disabling access to it.
